What are Weingarten Rights and Where Do They Come From?

Your Weingarten Rights guarantee you the right to have a Union Representative or steward present during any employer investigatory interview that you reasonably believe could lead to disciplinary action.

The Origin Story

These fundamental rights didn’t just appear overnight; they were established by a landmark decision of the U.S. Supreme Court in 1975.

  • When: The rights were officially established in 1975.
  • How: They stem from the Supreme Court case National Labor Relations Board (NLRB) v. J. Weingarten, Inc.

Who is Protected

The protection applies to unionized employees in the private sector who are covered by the National Labor Relations Act (NLRA). As members of Teamsters Local 481, you are covered!

Know Your Weingarten Rights

The Supreme Court has ruled that an employee is entitled to have Union Representativepresent during any interview which may result in his or her discipline.

There are several important elements to this right:

  1. You must request that a Union representative be called into the meeting in this capacity, the Union representative is safeguarding not only your particular interest, but also the interests of the entire bargaining unit to make certain that the employer does not initiate or continue a practice of imposing discipline unjustly.
  2. You must have a reasonable belief that discipline will result.
  3. You have the right to know the subject of the meeting. You also have the right to consult with your Union Representative prior to the meeting and to caucus during the meeting in order to seek advice and counsel.
  4. You should not refuse to attend a meeting even if a steward is requested but denied. We suggest that you attend the meeting and repeatedly insist upon your right to have a Union steward present. If this fails, then we suggest that you not answer the questions put to you in the interrogation.
